Thank you for using Developer Duck! These Terms of Service ("Terms") apply when you use our Mac application ("App") that uses OpenAI APIs to provide a chat interface for developers to help them code. By using our App, you agree to these Terms. Please read them carefully.
No registration is required to use our App. The service uses anonymous user IDs to differentiate user accounts. Purchases are made through Apple's service.
You agree to use the App in a manner that complies with all applicable laws and regulations. You acknowledge that the content generated by the AI might be similar to other existing content and may or may not be accurate. The accuracy and safety of the generated code are the responsibility of the user, not the service.
You may not use the App to:
(a) Transmit or share any hateful, sexual, or violent content. (b) Infringe, misappropriate, or violate any person's rights. (c) Reverse engineer, decompile, or otherwise attempt to discover the source code or underlying components of the App.
We reserve the right to cancel or remove any user at any time for any reason, including but not limited to the reasons listed above.
The venue for any litigation or arbitration arising out of or relating to these Terms or the App shall be in Texas.
Fees are collected by subscription and spent according to usage. Different features of the App may be more expensive than others, so billing may fluctuate depending on the customer's usage and the development of new features.
You may terminate your use of the App at any time for any reason by discontinuing its use. We may terminate your use of the App for any reason, including if we believe that you have violated these Terms or any applicable laws or regulations.
The App is provided "as is" without any warranties, express or implied. To the maximum extent permitted by applicable law, we disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
In no event shall we be liable for any indirect, incidental, special, consequential, or exemplary damages, including damages for loss of profits, goodwill, use, or data or other losses, even if we have been advised of the possibility of such damages.
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the revised Terms on our website or through other appropriate communication channels. Your continued use of the App after any changes to the Terms constitutes your acceptance of the new Terms.
These Terms shall be governed by and construed in accordance with the laws of Texas, without regard to its conflict of law provisions.
